The Victorian Society for Computers and the Law (VSCL) invites you to an in-person seminar on the Privacy Act 1988 and a discussion on possible developments in this important area of the law.

Recent significant data breaches have placed a focus on the effectiveness of the Privacy Act 1988 in protecting personal information, and prompted the recent introduction of the Privacy Legislation Amendment (Enforcement and Other Measures) Bill 2022 which, if enacted, would substantially increase penalties for privacy breaches. 

A simple increase in penalties will not, however, address other shortcomings in the Privacy Act.  The Act has not had a substantial overhaul since 2012, and Australia is now noticeably lagging behind other major economies which are progressively adopting GDPR concepts. 

The Attorney-General’s Department is considering a range of other changes although the precise scope of its recommendations remains the subject of speculation. 

In his presentation, Dr Gordon Hughes will outline the shortcomings of Australia’s existing data protection laws in comparison to world trends.

Dr Gordon Hughes AM is a principal at Davies Collison Cave Law, practising in the area of intellectual property, information technology law and data protection. 

Dr Hughes, who is a former president of the Law Council of Australia and an honorary life member of the Victorian Society for Computers and the Law, is the author or co-author of numerous texts including Data Protection in Australia, the third edition of Dean’s Trade Secrets and Privacy, and Computer Contracts: Principles and Precedents.
