Trade Marks on the Internet

Trade marks are used in a variety of contexts in the online environment, from websites to domain names to search engine results. As the internet becomes more and more a central focus of commercial activity, there is a growing body of jurisprudence, both in Australia and overseas, about the issues which arise in relation to the use of trade marks online. This seminar will review recent authority involving the use of trade marks on the internet and address questions such as:

  • What constitutes trade mark use in the online environment?
  • How is deceptive similarity assessed in the context of a domain name or search engine result?
  • What risks are involved in using competitors’ trade marks in search engine optimisation or marketing?

About the presenter

Stephen Rebikoff is a barrister who practises in commercial and administrative law, with a particular focus on intellectual property and technology, media and telecommunications, competition law and trade practices.

He is an experienced trial and appellate advocate, and regularly appears in the Federal Court and Supreme Court, as well as bodies such as the Trade Marks Office, Copyright Tribunal and Administrative Appeals Tribunal.

He has acted for a wide range of leading companies and brands, including Cadbury, Telstra, Facebook and realestate.com.au, and specialises in strategic litigation involving key intellectual property assets. He has been involved in a number of landmark cases involving common law rights in relation to colour, as well as copyright in telephone directories, computer software and databases.
