Topic Summary: Predictive coding is gaining increasing acceptance in the courts as an admissible way to tackle the discovery burden imposed by rapid growth in corporate datasets.  Healthy caution in the adoption of the still maturing technology has led to a welcome focus upon quantitative, statistical measures of process control and result certification in e-discovery practice.  
In this talk, we introduce the basic concepts of predictive coding
and describe its use in practice to craft a production in
e-discovery.  We then present an end-to-end protocol for
e-discovery, from production request to certified deliverable.
The protocol involves quantitative, sample-based measurement of
effectiveness, both for internal quality control and external
verification of results.  While many elements of the protocol can
be found in current e-discovery practice, the protocol as a whole
is to our knowledge novel, and stands somewhat in advance of
current procedural best practice.

 

The Speaker: : Dr. William Webber is a consultant in e-discovery

protocol design, statistical measurement, and the use of
predictive coding technology.  He received his PhD from the
University of Melbourne, with a dissertation on statistical and
metrical methods in information retrieval evaluation, and has
recently completed a two-year postdoctoral research fellowship in
the e-discovery lab of the University of Maryland, in the US.  He
has over 25 peer-reviewed research publications in the areas of
information retrieval and e-discovery.
